Terms of Service
By commissioning me, you agree to the following Terms.
General
- All drawings will include a signature that you MAY NOT remove.
- I can reject any order that I do not feel comfortable with for any reason.
- I will update my clients with sketches when asked and after the sketch is finished
DO and DON’TS
I WILL draw:
- Anthros (furries, dragons, etc.)
- Humans
- Creatures
- Original Characters (OC’s)
- Mild NSFW
I WON’T draw:
- Hateful content
- Political content
- Mechs
- Extreme fetishes
- Gore
- Realism & Hyper Realism
- Imitate other art styles or artist
Copyright
As the Artist, I claim the rights to the produced drawing, I reserve the full economic rights to the image, its use, and distribution.
As the Client, you are limited in you rights for the drawing, unless an agreement reached in advance or after the service was fulfilled.
Therefore, the Artist is allowed to use the copyrighted artwork, including:
- Posting, displaying, storing, distributing the commissions on electronic (web, social media, etc.), physical (printed art books, postcards, storage devices, etc.) or other media for purposes like self-promotion, advertising, portfolio, cataloguing, etc.
- Posting the artwork whenever wanted (while also giving credits for the character’s owner).
As the Client, you are allowed to:
- Edit, crop, resize your commission. At the same time, you can’t remove or crop the watermark intentionally if the technical requirements of the posting format do not require you to do so — it should remain completely visible.
- Post the commission to your own website or social media page, allowed for your personal use.
- Use the art to promote yourself.
- You are not forced to give me credit when posting but it is very appreciated. If the watermark is not legible in the given format, the Artist can be credited separately in text form in a legible manner by using a handle “@ScottCoyotte” or linking to one of the artist’s active web pages.
- Any of the given permissions can be overridden by an agreement made before the service is fulfilled.
- Print the artwork.
- May ask for updates on the commission whenever you like — I will get back to you as soon as I can to conclude under what terms the changes can be made.
- Use your artwork on YouTube/Twitch channel and monetized videos.
As the Client, you are NOT allowed to:
- Claim the artwork as your own.
- Reproduce or use the copyrighted work commercially. If this is your intention, we have to discuss a different kind of project.
- Remove, crop or alter my signature.
- Significantly alter the artwork without Artist’s consent.
- Use your commissioned art in training ML/AI models, or other purposes in this area.
- Turn your commissioned art into an NFT.
If the Client breaks any conditions stated above, they will lose all the before mentioned rights to the artwork, and the Artist will have the right to profit further from the commissioned artwork in any way the Artist sees fit.
Payment and refunds
The payment method is PayPal. All payments are done in USD.
All commissions are paid before coloring and rendering the approved final sketch. Payments are accepted only if there is already an agreement between the Artist and the Client.
The Client can’t get a refund once the sketch has been approved.
Process
Depending on the complexity, commissions can take 1-4 weeks to complete. Since I work, I try to balance the time as much as possible. However, I will always stay in contact with the client to inform about the progress of their commission, and will inform beforehand if any delay will happen.
I always send a sketch to my commissioners, asking if they would like to change anything before proceeding with the commission. Any changes made after this moment (if they may involve going back in the drawing process) will be charged additionally.
First, we will start discussing your commission, you will provide references and describe your idea. Afterwards, I will make 2-3 simple doodles for us to get a general idea, and once we have chosen a path, we can start drawing the final sketch.
After the final sketch is approved, I will wait for the commission to be paid, afterwards we will start coloring and rendering it. You will be updated through this process frequently.
Once the commission is finished, I will proceed to send you via email (or other preferred medium) your original PSD file, a jpeg, and a png file. This is when the service is considered to be fulfilled.
